Aeon Tax Liens Mark Schwartz - Fraud Attempted Theft Man in Danger of Eviction AFTER he paid off tax lien land contract

Cedric Bishop, owner of the property located at 3413 West 90th Street in Cleveland, Ohio is a victim of fraud by Aeon Financial Tax Lien Services.
 
 
Aeon Financial purchased two tax liens on the Bishop property.  One for $2,595.63 and one for $ 1,783.20.
 
Mr. Bishop lost his property via tax lien foreclosure and the deed transferred to Aeon Financial on April 19, 2012:

On May 10, 2012, Mr. Bishop entered into a Land Contract with Aeon Financial fbo CapitalSource Bank.

Under the terms of the Land Contract, Mr. Bishop agreed to pay $ 10,200 for the return of his family home, along with 8% interest.  

The agreement was a lump sum payment of $4,598 and the remainder to be paid in monthly installments of $422.74:

Although the total amount owed on the tax liens was $4,378.83, Mr.Bishop was forced to pay $10,200 plus 8% interest in order to save his home.
 
Shortly after the Land Contract was initiated, Mr. Bishop paid off the entire amount in full and was still charged the 8% interest although he paid off the land contract early. 
 
After the Land Contract was paid in full, Aeon transferred the deed back to Mr. Bishop on September 27, 2012.

Cedric Bishop paid off the Land Contract in FULL.   After Aeon Financial took his money, they simply transferred the deed back to themselves after using the property as collateral for a mortgage:

Although Cedric Bishop should be the legal owner of this property which he paid in full via land contract, he is NOT the legal owner.
 
This property remains under the ownership of Aeon Financial although NO DEED was ever filed transfering ownership from Cedric Bishop to Aeon Financial.  The newest deed transferred the property from CapitalSource Bank to Aeon Financial.  ( See the Cuyahoga County Recorder's office official records above )
 
Cedric Bishop is a victim of fraud.  He has all of his receipts to prove that he paid off the land contract in FULL.
 
 
Aeon Financial is in the process of selling Mr. Bishop's legally owned property.  Mr. Bishop has stated that he received several letters informing him that HIS house will be sold soon and that he needs to vacate his OWN property.
 
According to Cedric Bishop, he has made numerous phone calls to Aeon Financial's attorneys, and NONE of his phone calls have been returned.
 
According to Bishop, the County Fiscal Office has not helped him with this issue despite numerous attempts by Cedric Bishop to address this issue.  The county referred Bishop back to Aeon's attorneys who will not return his phone calls.
 
Cedric Bishop is in immediate danger of being evicted from his OWN house and lacks the financial means for an attorney.
 
 
 
The county made a mistake by accepting the deed tranferring the property from CapitalSource fbo Aeon Financial to Aeon Financial as this property's deed was not in CapitalSource's name - it was in Cedric Bishop's name.
 
Cedric Bishop was ripped off for $10,200 and is now facing an eviction threat.  Aeon Financial intends to sell Bishop's house after he paid them in full.

Cedric Bishop, " All I want is my house back "

Aeon Financial's attorney Kirk Liederbach finally returned Cedric Bishop's phone call after ignoring him for months.

 

According to Cedric Bishop, " They told me that they found my paperwork and figured out what was wrong.  The attorney is going to send me some paperwork, and he also told me that I overpaid and he is going send me a check for the overpayment, which I assume is for the 8% interest they charged me even though I paid off the land contract early.  I don't understand how this deed was transferred out of my name once they transferred the deed into my name after I paid off the land contract.  I never signed anything giving them permission to take the deed out of my name.  I am the legal owner of this property as I paid them $10,200 to give me back my home. I don't understand how they can take my money, transfer the deed into my name, receive a mortgage using my property as collateral after I paid them to return my house, and then they transferred the deed back to themselves.  What the hell is going on here.  I swear on a stack of bibles that this company is involved in fraud.  I can't believe the county allows this to happen.  I lost my property to them twice, and they took over $10,000 from me.  I don't trust anything they do.  When and if they transfer the property back to me, whose to say they won't take it again."

Busy day today

I intend to apply for a mortgage on my neighbor's property for myself.

It's Christmas time and I could sure use the money.  I am going to pick the most expensive house in the neighborhood and get a mortgage on it.

Walmart here I come!!

Although their property is not legally mine, I am going to use their property as collateral for a mortgage just like Aeon Financial Tax Lien did to the Cedric Bishop property.

After I obtain the mortgage, I am going to transfer their property to myself - without the knowledge or consent of the property owners.

Do you see the problem here?  

If the county and courts allow Aeon Financial to obtain a mortgage using property -which they do NOT own- as collateral and then transferring property - which they do not OWN - into their name without the knowledge or consent of the property owner, we might as well all start doing this.  

 

I am first in line.  I plan on getting mortgages for my entire neighborhood, work my way through Cuyahoga County, and then I will go  from state to state.

All across the country, I will obtain mortgages on every single property owned by others.

If Aeon Financial can do this and get away with it, so can the rest of us. 

 

 I believe that I will start with the Tax Lien King's property first.  I should be able to get a decent mortgage on this property:

Cedric Bishop - more fraud

Lots of FRAUD with the Cedric Bishop case:

 

The judicial report (final is filed 9-16-2011).  It is fraudulent.  Rebecca J. HIll of Complete Closing ( Rebecca Hill - Title Agent with NO license )
 
** Note that Rebecca Hill had no title guarantor as of July 15, 2011.  Title Resources dropped her.  She had no guarantor until 9-22-2011 when she picked up Westcor - then she surrendered her license on 11-29-2011.**
 
 
It was never replaced.  Despite the invalid/fraudulent final judicial report (she had not insurer backing it up - the letterhead of Title Resources Guaranty is worthless), they took the foreclosure to sale (no bidders).  Judge was Nancy Russo.  Magistrate John Dyke. 
 
 
 
Complaint was not filed til March 7, 2011.  That is important.  The notice of intent is dated November 2, 2010.  Hence, it was not filed within 120 days mandated by statute.  The tax certificates would be invalid under the statute because they dragged their feet in filing the foreclosure.  This would have been a good substantive defense in the underlying foreclosure by Capitalsource Bank fbo Aeon.
 
Nicholas Cardinal's signature on the motion for default.  Brady and Liederbach are all over the place.  
 
Brady testified that they replaced all the defective judicial reports once he learned about the HIll fraud on December 1, 2011.  His affidavit though states he knew in August, 2011 there was a problem, but he identifies the ex parte communication he had with the court's Chief Magistrate on December 7, 2011.
 
In the Bishop case, they did nothing.  Absolutely nothing.  Brady  testified  that a title report is only invalid if one could not go to final judicial report.
 
With all the other shenanigans these people have done to Mr. Bishop, there is a good fraud suit against Capitalsource Bank, Aeon, Brady, Liederbach, Schwartz, and Cardinal.  An attorney - knowing there is a fraud (such as Hill's title reports), must take steps to notify the tribunal and rectify them.
 

 

Nick Cardinal, Aeon's lawyer, called Bishop around the time Aeon filed for a default judgement, saying the law group lost all of Cedric Bishop's paperwork..
That paperwork was an agreement between Aeon and Bishop months earlier when he paid them $2,000 down payment and monthly payments of $400-plus beginning in June, 2011.
 
 
 
The Cedric Bishop final judicial report is filed 9-16-2011 with Title Resources as the guarantor.  This is out and out fraud.  When you combine the Brady affidavit of 4-13-2011 (notarized by the fake notary, Liederbach), and his knowledge of the problems with Hill's guarantor in August, 2011 and September, 2011, and then when you see in December, 2011, Title Resources told Brady to correct the situation because Hill had no authority to do anything.  What did Brady, Liederbach, Schwartz do?  Nothing.
 
And a man loses his home while they cover up their own malfeasance.
 
Cardinal is no better.
 
Meanwhile, the Ohio Dept. of Insurance did nothing in light of a complaint against the Hills.  Because they were no longer in Ohio and no longer licensed.   The agency wrote:  "Go to the FBI."
 
 

*** If the thieves were smart (which they are NOT), they will give Cedric Bishop back his house immediately AND return ALL of his money.  Otherwise, shit will hit the fan.***

 The attorneys have knowledge of the lack of license for Rebecca Hill.  The attorneys state that they removed the invalid judicial reports and replaced them with valid reports.

In the Cedric Bishop case, the invalid judicial report with Rebecca Hill's signature was used.

 

Although I have no proof, I believe there are many other cases filed during this time period in which the attorneys failed to replace the invalid judicial reports- despite their knowledge of the invalid reports and their sworn affidavits stating that all of the invalid reports were replaced.

This would be a simple task for the court.  Pull the docket for this time period and check the foreclosure files for Aeon Financial.  It is my understanding that there are approximately 40 cases with similar circumstances.

I am willing to bet my mortgage on Mark Schwartz's property that there are several other cases with invalid reports.

The most relevant parts of the OFFICIAL COURT TRANSCRIPT are below which details the knowledge of not only Aeon Financial's attorneys, but also knowledge of the court.

An attorney requested that the court investigate 80 cases, and to my knowledge the court has never done so.  If the court had investigated, Cedric Bishop would not have lost his home when the court relied upon the legal documents submitted by Aeon Financial's attorneys.

An immediate investigation into this issue must be made by the court and county.

Cedric Bishop fights to get his own house back

Mr. Bishop did not hear back from the half ass attorneys for Aeon Financial, and has not received any refund check.

On December 19, 2013, Mr. Bishop decided to take matters into his own hands.  

Mr. Bishop went to the County Fiscal Office himself to get his property back after it was stolen by Aeon Financial and  used as collateral for a mortgage by Aeon Financial. 

Bishop paid off the land contract he made with Aeon Financial in full in August 2012.

Bishop met with Kristy Neff from the county office and spent over one hour attempting to get his house back.

Bishop described Kristy Neff as being overly friendly, polite and helpful.  He noted something was not right with Kristy Neff's demeanor.

Mr. Bishop stated, " Something is very wrong here.  I believe that someone working for the county is involved with Aeon Financial.  I want to make sure this never happens to another person."

According to Mr. Bishop, Aeon Financial recently sent paperwork to the county for filing and in an attempt to correct the deed.  The deed that Aeon Financial attempted to file was rejected by the county.

Kristy Neff assured Mr. Bishop that she would make sure the paperwork was filed and recorded releasing the property back to Cedric Bishop, and Neff promised Bishop that she would send him a copy of the corrected deed.

Mr. Bishop also stated that Kristy Neff told him that her office is aware of the problems with Aeon Financial and is investigating.

The on-line record was corrected on December 19, 2013 which transferred the property from Aeon Financial back to Cedric Bishop:

Tax Lien Sale Investigation

I believe there is an improper relationship with a county employee and a main player with the tax lien investors.

The requested investigation is to determine if there is any connection (including family)  between Woods Cove Tax Liens and Aeon Financial Tax Liens.

David Schwartz ( Woods Cove ) and Mark Schwartz ( Aeon Financial ) are COUSINS.  

 

Housing advocates seek information on Cuyahoga County's vetting of tax lien buyer

CLEVELAND, Ohio -- Cuyahoga County housing advocates want to know more about how thoroughly the county vetted the company that bought $18 million in property tax liens earlier this year.

Frank Ford, chair of the Vacant and Abandoned Properties Action Council, in a Dec. 19 letter asked County Inspector General Nailah Byrd for public records that document how her office screened Woods Cove LLC before the company bought the the right to collect unpaid taxes, plus interest and fees, on the county's delinquent properties.
Byrd earlier this month began a different review of Woods Cove after Mark Schwartz, an attorney who is associated with Aeon Financial, a different past purchaser of Cuyahoga County tax liens, alleged that Woods Cove charges improperly high interest rates in how it structures its payment plans.

Deed filed for Cedric Bishop

After Cedric Bishop tried for months to get his house back from these thieves, Aeon Financial's half ass attorneys finally filed his deed.

 

Note the word " Corrective"  and note the time stamp on this 12/19/13 at 4:27 p.m. :

Note , " * This deed is meant to correct the incorrect transfer of this property to Aeon Financial out of the name of Cedric Bishop"

The deed was signed by disbarred attorney John A Lord who is an 'authorized signatory' for Aeon Financial LLC.

Caught red handed stealing Cedric Bishop's property.  I wonder how many other unfortunate victims are out there??
