Cuyahoga County Delinquent Property Tax Lien Sale - Flaw in System or Violation of Civil Rights - Fair Housing Act?

Is there a flaw in the system of picking and choosing which delinquent property tax liens to sell in Cuyahoga County or is this a Civil Rights Violation?

Based on my extensive research which consists of hundreds of hours over a three year span, I have noticed a trend with the victims who have lost their property via delinquent property tax lien sales. 

Most of the victims who have lost their properties are all black.  

The property that ends up in the hands of greedy, no good for nothing, thieving tax lien investors was taken from black property owners on the east side of Cleveland, East Cleveland, and eastern suburbs.

I just finished researching most of the 2,629 tax liens sold to CapitalSource fbo Aeon Financial and discovered that a very large percentage of the liens sold to this scum tax lien company were all located in minority concentrated areas- East Cleveland, Cleveland's East Side, and Eastern Suburbs.

Same issue with Plymouth Park Tax Services from 2004-2008.  The majority of the victims that lost their property were  black property owners.

Nearly every person that contacts me regarding this issue is black.

Most of the victims that I met are black.

Nearly all  of the properties that I visited regarding Plymouth Park Tax Services were located in minority concentrated areas.

Almost every single property owned by Aeon (243 houses) that I plan on visiting to report code violations is on the east side- minority concentrated areas.

I had my suspicion regarding this issue a few years ago and met with an East Cleveland Councilman over my concerns.  The councilman agreed with me and promised to hand deliver my documents to George Forbes.  A few hours later, the councilman called me to confirm that he went to Forbes' home and gave the documents to George Forbes' wife.  George Forbes never contacted me regarding this issue.

I personally delivered my proof to the NAACP and spoke with Stan Miller several times.  Stan Miller completely blew me off and we had a heated phone discussion over this issue.  I have not heard back from Stan Miller or the NAACP for approximately two years.  The victims that I sent to NAACP were also ignored.

Had this issue been addressed when I brought it to the attention of several people a couple years ago, it would not have snowballed.  Now the issue of black property owners losing their properties via the tax delinquent foreclosure process has only multiplied.

Either there is a flaw in the way that Cuyahoga County is picking and choosing the liens to sell, or this is a blatant civil rights violation.

I have researched property on the west side of Cleveland and found hundreds of properties that have been delinquent for years with no tax lien sale. 

Political people and those connected to political people get away without paying property taxes for years and do not face the same consequences.

If you are a black property owner and delinquent with property taxes, you are at a greater risk of losing your property to thieves that do NOT pay their own property taxes after taking property from others.

For the record, I am a white person and not pulling race cards.   This is more than obvious.

Black property owners are losing their homes in record numbers and are at a great disadvantage with the delinquent property tax lien process.  There is a serious problem here.

Company that bought Cuyahoga County tax liens is gouging property owners, according to former attorneys
CLEVELAND, Ohio -- An out-of-state tax collection firm that has bought thousands of Ohio tax liens hoping to make a profit has violated state law by assessing high interest rates on property owners in Cuyahoga and other counties, according to two attorneys who once represented the firm.
The attorneys, Mark Schwartz, of Chicago, and Kirk Liederbach, of Cleveland, made the allegations against Woods Cove II in a Nov. 26 letter to Ohio Attorney General Mike DeWine. Woods Cove II officials later called the assertions false.
In the letter, which is also copied to county treasurers in Cuyahoga, Hamilton and Summit counties, the attorneys say that Woods Cove II sets up its payment plans to artificially assess interest after the principals are paid off.
The practice helps boost Woods Cove II's investors' rate of return, but also inflates the effective interest rates property owners end up paying to between 26 percent and 450 percent, breaking Ohio's legal limit of 18 percent, the attorneys say.

Foreclosure lawsuits on the rise in Summit County

Foreclosure lawsuits are back on the upswing in Summit County.
But it’s not because of banks and mortgage companies.
A California investment firm that has purchased thousands of property tax liens in the county over the last several years filed 681 foreclosure suits in the first six months of the year, accounting for 37 percent of all the filings.
Overall, the county recorded 1,842 mortgage and tax foreclosure suits over that period. There were 2,389 all of last year.
Without the lawsuits by Woods Cove II LLC of Pasadena, the county would have been on pace for about the same or even fewer than last year, said Daniel Horrigan, county clerk of courts.
“That’s still too high,” he said. “You don’t want any foreclosures.”
The Woods Cove lawsuits weren’t a surprise to county officials who had been notified last year that the company planned to seek foreclosure on as many as 1,032 properties.
Woods Cove has been the largest purchaser of tax liens in the county. Since 2011, the company has bought nearly $21 million worth, representing 4,611 properties.
Ohio law allows counties to sell tax-lien certificates to investors, who then go after the unpaid taxes. Investors charge the property owners the principal and interest to clear the lien.
If the owner doesn’t pay, the investor can foreclose after a year.
Summit hands out the money raised through the sales to schools and municipalities that are losing out on the unpaid property tax revenue.

 

Woods Cove couldn’t be reached for comment.
