Another point of concern is that even after learing his fate, Sammy continued to place the blame on Guy and others. He even stated that Guy was disruptive at a the meeting when he submitted a letter calling for the TWDC Development Director's dismissal. Myself and others were present at that meeting and no such conduct was displayed by Guy. He read the letter aloud to the TWDC Board members. Also, he attended a board meeting after being given the Restraining Order and provided the TWDC staff and board members with a copy of the TRO. There were conditions placed
There were conditions placed on Sammy's one year "inactive" probation.
First: He was sentenced to 180 days plus $1,000 fine on the Aggravated Disorderly Conduct: The 180 days and $500 of the $1,000 was suspended.
He was sentenced to 30 days in jail and $250 on the Menacing charge. The 30 days were suspended along with $200 of the $250.00 fine.
Secondly, and very importantly, the "inactive" probation was to be based on his ability to pass a alcohol and drug urinalysis test before leaving the courthouse on Friday. If he failed the tinkle test, he would be required to return to court to be placed on active probation. The question to be considered here is, did he actually take the urine analysis test and did he pass it? Since he advised Judge Stokes that he had consumed some medication prior to coming to court, I would not be suprised if his attorney managed to get a "rain-check" so he could flush the pipes before providing a sample.
Third, a "No-Contact" order was to remain in effect for the duration of the probation period.
Fourth, Sammy is to consume absolutly NO alcohol or illegal substances (drugs) for the duration of the "inactive" probationary period.
Guy was kind and generous enough to say that he did not want to see Sammy go to jail. That at times Sammy could be a wonderful person and that he did many good things for the community. However, Guy did state that he would rather see Sammy on Active probation. Guy even offered up a solution for making the no contact order succeed without Sammy getting into any further trouble. Guy said that if he needed to attend committee meetings or utilize TWDC's services, that he would place a courtesy call in advance of going to the office so that Sammy would have an opportunity to leave the building before Guy arrived.
What I found really interesting is that when Sammy was given an opportunity to speak, he did not make a diect apology to Guy. He only did it in a round about way after Judge Stokes ask him if he meant the apology for Guy.
