The sad case of Evelyn Schwartz has created a lot of controversy for well over one year.   Here is one side of the controversy , and below is another version:

For the past 15 years, DEAN MARINPIETRI, a handyman, has provided care for Evelyn,  and at some point of time Dean moved in the home with the elderly lady.

Allegations of possible neglect and other concerns caused Evelyn to be removed from her home:

COUNTY OF CUYAHOGA :

LYNETTE HOOD, being first duly sworn, states that she is of sound mind, competent to testify, has personal knowledge of the facts contained herein and they are true to the best of her knowledge and belief:

1. Affiant is employed as a social worker for the Cuyahoga County Department of Senior and Adult Services, Adult Protective Services (APS), 1701 E. 12, Cleveland, Ohio.

2. hi the course of her employment, affiant has investigated a referral concerning the adult Evelyn Schwartz, whose date of birth is April 19, 1916 and whose address is 1143 Genessee Ave., Mayfield Heights, Ohio 44124.

3. Ms. Schwartz requires assistance with her activities of daily living and instrumental activities of daily living.

4. It has been reported that Ms. Schwartz suffers from osteoarthritis, diabetes, atrial dibrillation, weakness in her legs, and forgetfulness. It was also reported that she has an unsteady gait and is at risk for falls.

5. Ms. Schwartz relies on the assistance of a man named Dean Marinpietri who resides with her.

6. Mr. Marinpietri refused to allow Ms. Schwartz to receive home care services after she was discharged from a nursing facility.

7. It has been reported that Mr. Marinpietri is very intimidating and has a criminal record.

8. Ms. Schwartz's health care power-of-attorney Dorothy Buzek resides in Georgia. Her sister-in-law Eleanor Uhlir lives in Olmsted Township and has also been unable to visit or speak with Ms. Schwartz.

9. APS was able to successfully visit several times with Ms. Schwartz but at this time Mr. Marinpietri is refusing to allow me to visit Ms. Schwartz. APS has been unable to see Ms. Schwartz since April 1, 2009.

10. Ms. Schwartz is unable to manage her finances independently. 

 Dean Marinpietri, the live-in caregiver, has serious criminal convictions and a violent history.  Dean was just recently released from prison.

 In 1986, Dean's mental health was questioned and the court ordered a psychiatric evaluation on Dean Marinpietri.

BETTY BROWN, Dean Marinpietri's ex-girlfriend, has spent a lot of time spreading the word on Evelyn Schwartz's removal from her home by the APS.  Betty is a member of http://www.countygrandjury.org  and actively promotes this organization.

. The sovereign citizen movement is an extreme anti-government movement whose members believe the government has no authority over them. Although its sister movement, the militia movement, has garnered more publicity, the sovereign citizen movement is also growing, is larger than the militia movement, and engages in a much greater amount of criminal activity. 

  More widespread than violence is a set of tactics known as "paper terrorism," in which sovereign citizens use legal filings to harass, intimidate, and retaliate against public officials, law enforcement officers, and others.

 In addition to their acts of violence, many sovereign citizens have engaged in a variety of scams and frauds, some of them raking in millions of dollars, while countless more sovereign citizens have engaged in acts of harassment, retaliation, and intimidation against public officials, law enforcement officers, and private citizens.

 As is true for most types of extremist movements, the sovereign citizen movement has come to rely heavily on the Internet for propaganda, recruitment, and funds.

The internet is also useful for sovereign citizen con artists to reach gullible victims and cause unsuspecting citizens to become members with stories that reflect emotion and sympathy.   Are you gullible?

Who are the "Sovereigns"?

It would be tempting to dismiss the violence that took place that day as an isolated event — an unstable father and son who exploded in a moment of vicious, unexplained fury. The truth, however, is more frightening. Jerry Kane and his young son were active participants in the sprawling subculture of "sovereign citizens" in America: hundreds of thousands of far-right extremists who believe that they — not judges, juries, law enforcement or elected officials — get to decide which laws to obey and which to ignore, and who don't think they should have to pay taxes. While law enforcement officers may disagree on how to deal with or even label this extremist subculture, one thing is certain: it's trouble. The sovereign movement is growing fast, and its partisans are clogging up the courts with their indecipherable filings. When cornered, many of them lash out in rage, frustration and, in the most extreme cases, acts of deadly violence.
