EMERGENCY RESOLUTION OBJECTING TO ROWLEY INN

Whereas, the uniform date for

renewal of liquor permits in the

State of Ohio is October 1st; and

Whereas, pursuant to Section

4303.271 of the Revised Code, the

legislative authority of a municipal

corporation may object to the renewal

of a permit based upon legal

grounds as set forth in division (A)

of Revised Code Section 4303.292;

and

Whereas, the applicant is unfit to

continue to engage in the liquor permit

business in that he has operated

his liquor permit business in a

manner that demonstrates a disregard

for the laws, regulations or

local ordinances of the state, and

that this objection is based on other

legal grounds as set forth in

Revised Code Section 4303.292; and

Whereas, this resolution constitutes

an emergency measure providing

for the immediate preservation

of the public peace, prosperity, safety

and welfare pursuant to Section

4303.271 of the Ohio Revised Code,

objections to renewal of liquor permits

shall be made no later than

thirty days prior to the expiration

date of the permit; now, therefore,

Be it resolved by the Council of

the City of Cleveland:

That Council does hereby

record its objection to the renewal

of a D2, D2X, D3 and D3A Liquor

Permit, Permit No. 6985049 owned by

Rowley Inn, 1104 Rowley Avenue,

1st floor and basement, Cleveland,

Ohio 44109, and requests the Director

of Liquor Control to set a hearing

for said application in accordance

with provisions of Section

4303.271 of the Revised Code of Ohio.

 This Resolution came out in the Aug. 25, City Records, that was posted either yesterday or today.

Today, I communicated with the Councilman and shortly afterwards, I spoke with Ted and he informed me that Councilman Cimperman and he talked and the Councilman assured him there was nothing to worry about.

This is one I'll fight for.  The Rowley Inn has a complete clean record.  No citations, a clean record with the health dept.  All his permits and licenses hanging in plain view on the wall.  Has been owned by Ted for approx. 35 years, This has been considered the "working man's bar" from the beginning.  He has many Old Time South Siders not only as friends but as customers as well that will rally to support him.

Right across the street and....the Christmas Story House was just before the Zoning Board asking for a variance to open a gift shop.  There was something to the effect that Councilman Cimperman had to have the area re-zoned for that to happen.

It's a darn shame that a life-longTremonter - born right here on Jefferson Avenue, raised his kids in that bar, owned it for more than 35 years, a life long member of St. john Cantius Church, has a son on the Cleveland Police Dept. (25 years - 20 at second district) and is being put through the wringer....for what?

Not to mention, he is a super nice guy, cooks really good food and has many long-time patrons, friends and supporters who live right here in this community.

Rowley has always been known as "the working man's bar"

Durh,  Rowley's happens to be right across the street from the Christmas Story House- which draws thousands of visitors and sells lots of leg lamps- and now the Christmas Story House would like to expand to include a gift job.  How nice.

If we declare Rowley's bar ( which happens to be in a really good location right across the street from the Christmas Story House) a public nuisance, I can get all of my council buddies to vote with me and shut this shit down.

Don't leave out how this life-long up-standing citizen (applicant) is declared "unfit." and demonstrates a disregard for the laws. 

Flying Monkey and other places on Tremont's main drag have broken the laws for years - including noise complaints, non-permitted patios, non-permitted entertainment and lack of required parking facilities, yet.......Cimperman supported them at the BOZA hearing and somehow Sammy catania showed up with 140 letters of support for Flying Monkey, who variance condition was based on turning the speakers off at 10:00pm Sunday through Thursday and 12 midnight on Friday and Saturday.  Since the BOZA hearing, they have been recorded at least twice with music blarring until 12:30 - 1:00 am.  Is this not disregarding laws?

Interesting to know who signed those letters.  I wonder if they had "X" marks on the signature lines?

If the tourists knew what is good, they would high tail it over there after a visit to the Xmas House - one of the few affordable places left in Tremont and good people - no wonder they want to shut it down.

I hear there are certain want-to-be buyers after the Rowley to turn it into one of Tremont's Trendy high-priced hot-spots that a poor working man can't afford to patronize.

 There will be no BOZA hearing on this matter due to the following:

1)     Mr. Polansky did not apply for any review…his architect did without him knowing.

2)     There will be no changes to the building what so ever.

3)     If the business is sold or building is sold then the new people will have to bring all into current state(s) of compliance.

4)     As a side note: if there are any further safety or nuisance issues this summer, the liquor license renewal  will be coming up in October

5)     Mr. Polansky, the neighbors, Kristen and the Councilman met together to discuss this and for now there is no GNA to be had.

6)     The issue is withdrawn from BOZA.

This matter was just cleared up in the spring of 2010.  As you can see, this memo that was sent out by TWDC Staff Members, Sammy and Kristen, Item #4 plainly makes it known that they were planning on going after this bar again....and they did by Cimperman objecting to the liquor license.

Since this long time Tremont resident and business owner has no violations, a clean slate with the City's Health Dept., all the necessary permits and no noise complaints to the Police Dept., one must ask the questions:  Why is this bar being targeted by TWDC and the Councilman?

How can there be any further "safety or nuisance" issues, if there were none to begin with?

Wow...another place I have visited and "Bumped" into one of those "politicians" (SANTIAGO)  gets attention like this??? 

I guess that these guys are going to cite, violate, and condemn every place "ANGELnWard14"  associates with to make their point that they are angry that I revealed so many of their dirty, underhanded, and unscrupulous political games that have hurt the public at large for too long!!!

Intriguing! Where are they going to go next??? They have hit my homes, my family's property, the coffeehouse, and now that bar where I dropped off a can of ALUMINUM BEER TABS for the veterans??? 

This is absolutely amazing to watch before my eyes... Shady politics....

I certainly hope the FEDS are paying attention to these moves by these "elected officials!" I hope that they bring 'em all to their knees! The elected officials of our area took us all for a ride and thought it would never end ---at our expense!!!

Truly pathetic! 

Start targeting the WHITE COLLAR CRIMINALS at CITY HALL and leave the real people who work hard everyday alone!!!
